Please read these Terms of Use ("Terms") carefully before using FreeUpMyMac ("the App"), operated by Tunde Alao ("we," "our," or "us"), based in London, United Kingdom.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on devices that you own or control, subject to these Terms.

You may not:

• Copy, modify, or distribute the App

• Reverse engineer, decompile, or disassemble the App

• Rent, lease, lend, sell, or sublicense the App

• Use the App for any unlawful purpose

2. Description of Service

FreeUpMyMac is a macOS application that helps you analyze disk storage usage and identify files that may be safe to remove. The App includes a "Smart Check" feature that provides recommendations on whether specific files are safe to delete.

3. Your Responsibility

You are solely responsible for any files you choose to delete using the App.

While we strive to provide accurate recommendations through the Smart Check feature, we cannot guarantee that any file identified as safe to delete will not affect your system or data. Before deleting any files:

• Review the files carefully

• Ensure you have adequate backups of important data

• Understand that deleted files may not be recoverable

We strongly recommend maintaining regular backups of your Mac using Time Machine or another backup solution.

4. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY OF ANY RECOMMENDATIONS

We do not warrant that:

• The App will meet your specific requirements

• The App will be uninterrupted, timely, secure, or error-free

• The results or recommendations provided by the App will be accurate or reliable

• Any errors in the App will be corrected

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUNDE ALAO, FREEUPMYMAC, OR ITS AFFILIATES BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF DATA, FILES, OR DOCUMENTS

• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES

• DAMAGE TO YOUR DEVICE OR SYSTEM

• COST OF RECOVERY OF ANY LOST DATA

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.

6. Purchases and Refunds

App Store Purchases

If you purchase the App through the Apple App Store, your purchase is subject to Apple's terms and conditions. Refund requests for App Store purchases must be made through Apple.

Website Purchases

If you purchase the App through our website, your payment is processed by Lemon Squeezy. We offer a 30-day money-back guarantee. To request a refund, contact us at the email address below within 30 days of purchase.

7. Intellectual Property

The App, including its design, features, code, graphics, and content, is owned by Tunde Alao and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

8. Updates

We may release updates to the App from time to time. These updates may include bug fixes, new features, or security improvements. Some updates may be required for continued use of the App. Your continued use of the App after an update constitutes acceptance of any changes.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your license to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede any prior agreements.
